1. Acceptance of Terms

By accessing or using Contractor Whale (the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, subscribers, and visitors.

2. Description of Service

Contractor Whale is a B2B subscription service that delivers curated lead data sourced from Texas public records — including building permits and warranty deed transfers — to licensed contractors and related trade professionals. Leads are delivered via email digest on a weekly basis.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By creating an account, you represent and warrant that all registration information you submit is truthful and accurate.

4. Subscriptions and Billing

  • The Service is offered on a subscription basis with plans billed monthly or annually as selected at signup.
  • Subscription fees are charged in advance and are non-refundable except as required by applicable law.
  • We reserve the right to change pricing with at least 30 days' notice to existing subscribers.
  • Failure to pay may result in suspension or termination of your account.

5. Free Trial

We may offer a free trial period at our discretion. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends. We reserve the right to modify or terminate free trial offers at any time.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Resell, sublicense, or redistribute lead data to third parties without our written consent
  • Use the data to harass, spam, or engage in unlawful marketing practices
  • Scrape, copy, or systematically extract data from the Service beyond normal use
  • Use the Service in any way that violates applicable federal, state, or local law
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure

7. Data Accuracy Disclaimer

Lead data is sourced from publicly available Texas government records. While we strive for accuracy and timeliness, Contractor Whale makes no warranties regarding the completeness, accuracy, or fitness for a particular purpose of the data provided. Public records may contain errors, omissions, or delays. You assume all risk associated with reliance on the data.

8. Intellectual Property

All content, features, and functionality of the Service — including software, design, text, graphics, and logos — are owned by Contractor Whale and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your internal business purposes.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or any conduct we deem harmful to the Service or other users. You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing period.

10. Limitation of Liability

To the fullest extent permitted by law, Contractor Whale shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months prior to the claim.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Texas.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. SMS / Text Messaging

If you provide your mobile phone number at signup and check the SMS consent box, the following terms apply. Contractor Whale separates SMS messages into two consent categories — transactional and marketing — and treats them as two distinct opt-ins:

  • Transactional SMS (covered by the signup checkbox). The SMS consent box on the signup form authorizes Contractor Whale to send you transactional messages only, including account alerts, digest delivery notifications, billing notices, password reset and security confirmations, and other service-related communications. No marketing messages are sent based on this consent alone.
  • Marketing SMS (requires a separate opt-in). Marketing messages — including promotions, new feature announcements, upsells, and other commercial communications — require a separate opt-in available in your account settings. Checking the SMS box at signup does not grant marketing consent, and we will not send marketing SMS until you explicitly enable it later.
  • Frequency. Message frequency varies based on the consent categories you have enabled and your account activity.
  • Charges. Message and data rates may apply per your mobile carrier's plan. Contractor Whale does not charge for SMS.
  • Opt out. Reply STOP to any text message to immediately unsubscribe from any SMS category (transactional or marketing).
  • Help. Reply HELP to any text message for support contact information.
  • Consent is not a condition of purchase. You may use Contractor Whale without opting in to either SMS category.
  • Privacy of phone data. See our Privacy Policy for how we collect, store, and protect your mobile number.
  • Carrier disclaimer. Carriers are not liable for delayed or undelivered messages.
